Terms of Service

These terms govern your use of the Certified Safe LLC website and the cleaning and restoration services we provide. By requesting a quote or scheduling work, you agree to these terms.

1. Who these terms apply to

These terms apply to anyone who visits our website, requests a quote, or hires us for work. “We,” “us,” and “our” mean Certified Safe LLC, a Massachusetts limited liability company. “You” means the person or business engaging us or using the site.

2. Use of the website

The website is provided for informational purposes. You agree not to:

  • Use the site in a way that violates any law or infringes anyone’s rights.
  • Attempt to interfere with, scrape, or disrupt the site or its hosting.
  • Submit false, malicious, or spam form submissions.

Content on the site (text, images, logos, the name “Certified Safe”) is ours or used under license. Do not reproduce it without permission.

3. Quotes and estimates

A quote is an estimate based on the information you give us and what we can observe before starting. Final pricing may change if the job turns out larger, more contaminated, or more complex than described. We’ll tell you in writing before any additional charges are added, and we’ll pause the work if you prefer to stop or get a second opinion.

Quotes are valid for 30 days from the date issued unless we state otherwise in writing.

4. Scope of work and scheduling

We’ll confirm the scope of work (what service, at what address, when) by email, text, or WhatsApp before starting. That confirmation plus the quote is your service agreement. Services we may perform include:

  • Air duct cleaning
  • Mold remediation
  • Chimney sweeping and inspection
  • Carpet and upholstery cleaning
  • Dryer and vent cleaning
  • Odor removal
  • Water damage mitigation

Arrival windows are scheduled in good faith. Weather, traffic, and emergency dispatches may shift a window; we’ll keep you informed.

5. Site access and conditions

You agree to:

  • Provide safe access to the property and the areas we’re treating.
  • Disclose known hazards (e.g., lead paint, asbestos, electrical issues, structural damage, pests) before work begins.
  • Secure pets, medications, valuables, and fragile items before we arrive.
  • Ensure adequate water and electricity are available for the equipment we’ll use.

If the working conditions differ materially from what you described, we may re-quote, reschedule, or decline the job for safety reasons.

6. Payment terms

  • Residential jobs are generally due on completion unless agreed otherwise in writing.
  • Water damage or larger restoration jobs may require a deposit or milestone payments as detailed in your service agreement.
  • Commercial and insurance-billed jobs follow the terms in the signed work authorization.
  • We accept card, ACH/bank transfer, cash, and approved check payments. Card payments are processed by a third-party processor.
  • Invoices more than 30 days past due may accrue a late fee of 1.5% per month or the maximum permitted by Massachusetts law, whichever is less. You’re responsible for reasonable collection costs we incur for unpaid balances.

7. Cancellations and rescheduling

Please give us at least 24 hours’ notice to cancel or reschedule a non-emergency appointment. Short-notice cancellations or lock-outs at the scheduled arrival may be subject to a trip fee. Deposits for mold remediation and water damage projects may be non-refundable once we’ve mobilized crew and equipment; specific terms will be stated in your service agreement.

8. Warranty and what’s not included

We stand behind our work. If you’re not satisfied with a service we performed, contact us within 7 days and we’ll return to re-clean the area in question at no extra charge, where applicable.

Our services are not guaranteed to:

  • Remove every stain, discoloration, odor, or damage embedded in building materials.
  • Repair pre-existing structural, mechanical, plumbing, or HVAC defects.
  • Prevent future mold growth, water intrusion, pest activity, or odor return caused by factors outside our control (e.g., leaks not yet repaired, humidity issues, pet activity).
  • Substitute for construction, roofing, plumbing, electrical, or licensed contractor work not within our scope.

Except as stated above and as required by Massachusetts law, services are provided “as is” without additional warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

9. Limitation of liability

To the maximum extent allowed by law, Certified Safe LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from the website or services (for example, lost profits, lost business, loss of data, or emotional distress). Our total liability for any claim arising from a service is limited to the amount you paid us for that service.

Nothing in these terms limits liability that cannot be limited under Massachusetts law, including liability for gross negligence, willful misconduct, or personal injury caused by our negligence.

10. Insurance and licensing

Certified Safe LLC is licensed and insured in Massachusetts. A certificate of insurance is available to customers on request for projects that require one. Where a specific license or certification is required for a service (for example, chimney or mold work), we’ll provide the applicable credential on request.

11. Intellectual property

The Certified Safe name, logo, shield mark, color system, and website copy are owned by Certified Safe LLC or licensed to us. You may not copy, mirror, or rebrand them. Photos we take on the job site remain our property and may be used in marketing; if you prefer we not use photos of your property, tell us in writing and we’ll exclude them.

12. Phone, SMS, and WhatsApp

Certified Safe LLC sends transactional text (SMS) messages from our toll-free number (855) 723-3808. By submitting our quote form, calling us, or texting us first, you consent to receive SMS messages from Certified Safe LLC about your service request — including quote follow-ups, appointment confirmations, reminders, on-the-way notifications, and post-service follow-ups.

Frequency: message frequency varies by your specific request — typically a small number of messages tied to your service inquiry, not a marketing broadcast. We do not send promotional or recurring marketing texts.

Carrier disclaimer: message and data rates may apply from your carrier.

Opting out: reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any SMS to stop receiving messages. Reply HELP for help. You can also reach us at certifiedsafellc@gmail.com or (855) 723-3808.

13. Disputes and governing law

These terms and any dispute arising from them or from our services are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Before filing a lawsuit, you agree to contact us in writing and give us 30 days to resolve the issue informally.

If a dispute is not resolved informally, you and Certified Safe LLC agree that the state and federal courts located in Massachusetts will have exclusive jurisdiction, except where a law (such as a consumer-protection statute) gives you the right to file elsewhere.

14. Changes to these terms

We may update these terms from time to time. The “last updated” date above shows the most recent change. The terms in effect on the date of your quote apply to that project, unless a newer set is signed.
